~ COMPLAINT PROCESS ~

Upon the receipt of a signed, written complaint that contains the minimum information required under 1127.01 (b), the Bureau of Education Shall:

o  Within one day notify by phone the public agency (LEA, Special Education Director and SAU Superintendent) that a complaint has been filed;

o  within one day mail a letter to the complainant acknowledging the receipt of the complaint;

o within two days mail a copy of the complaint to the public agency by certified mail;

o  within one week assign the complaint to an investigator.

o  Within 10 days the investigator will contact both the complainant and public agency;

o  within 40 days the investigator will interview the complainant, public agency personnel, and review any documents necessary for a complete investigation;

o  within 40 days the investigator will complete the investigation and provide a report to the Bureau;

o  within 60 days the Department will issue a decision concerning the complaint.

o  Within 10 days of the receipt of the Commissioner's decision, any party to the complaint may request the Commissioner to reconsider the decision;

o  within 20 days of the receipt of the request for consideration the Commissioner will issue the final written decision; and

o  any party who is aggrieved by the final decision of the Commissioner may appeal according to Ed 1127.04 (c).
